# Regulators as power brokers: FDA, EMA and the geopolitics of approval
In December 2020, the UK's MHRA (Medicines and Healthcare products Regulatory Agency) authorized the Pfizer-BioNTech COVID-19 vaccine a full week before the US FDA (Food and Drug Administration) and roughly three weeks before the EMA (European Medicines Agency). Same data package, same manufacturer, three different clocks. That gap in timing was not a technicality. It determined which populations got protected first, which governments looked competent, and which company captured early pricing power before competitors caught up. Regulators do not just referee the pharmaceutical industry. They set the starting gun, and sometimes they change the race distance mid-run.
This lesson looks at how the FDA, EMA and their peers function as strategic actors, not neutral gatekeepers, and why understanding their incentives is core to understanding competitive dynamics in pharma.
In most industries, regulators sit outside the competitive game. In pharma, they are inside it.
No drug can be sold legally without regulatory approval. That single fact gives agencies enormous leverage over three things that determine winners and losers:
A six-month approval delay can be worth hundreds of millions of dollars to a company facing patent expiry or a fast-following competitor. A narrower label (say, "second-line therapy only" instead of "first-line") can shrink a drug's addressable market by half. Agencies control both levers.
The FDA approves drugs for the US market under authority from laws like the Federal Food, Drug, and Cosmetic Act. It is a single national agency with centralized decision-making.
The EMA coordinates a more federated system: it issues a scientific recommendation, and the European Commission grants EU-wide marketing authorization, but pricing and reimbursement remain decided country by country (Germany's IQWiG, France's HAS, and so on). This means EMA approval is necessary but not sufficient for European market access. A drug can be legally approved in the EU and still not be reimbursed, and therefore not really sold, in a given country for months or years.
This structural difference matters for competitive strategy. US launches tend to be faster and more binary (approved and priced, or not). European launches are slower and fragmented, forcing companies to run country-by-country pricing negotiations even after EMA sign-off.
Practical effect: a mid-size biotech with limited launch capital often prioritizes the US first, because one approval unlocks one market, whereas the EU requires sequential national battles.

The tradeoff: accelerated approvals sometimes get walked back. Several oncology accelerated approvals have been withdrawn after confirmatory trials failed to show survival benefit, most notably a wave of PD-1/PD-L1 immunotherapy indication withdrawals in the early 2020s. Regulators tightening scrutiny on accelerated pathways can strand a company's revenue forecast overnight.
The pandemic compressed years of normal regulatory divergence into months, making the power dynamics visible in real time.
The result: identical vaccines had wildly different market access timing depending on which regulator a manufacturer engaged first, and that timing sequence shaped which company became the "default" vaccine brand in each region. Moderna and Pfizer-BioNTech's early Western authorizations gave them years of near-monopoly pricing leverage in high-income markets, while AstraZeneca's earlier rollout in lower-income countries (partly via its non-profit pricing commitment) built different distribution relationships entirely.

Regulatory divergence creates strategic optionality for large, well-resourced companies and real disadvantage for smaller ones.
Big pharma incumbents (Pfizer, Novartis, Roche, Merck) run parallel regulatory strategies: filing simultaneously in the US, EU, Japan and China, with dedicated regulatory affairs teams for each jurisdiction. This is expensive but lets them capture whichever market approves first and use that approval as leverage (safety and efficacy data package) to speed up filings elsewhere.
Smaller biotechs typically cannot afford this. They often pick one lead market (usually the US, because it is the largest single pricing-unconstrained market) and license out or partner for the rest. This is one reason large-cap pharma companies acquire promising small biotechs after Phase II data: the acquirer supplies the multi-jurisdiction regulatory muscle the target lacks.
Regulators also compete with each other reputationally. An agency seen as too slow risks losing "first review" status to a faster peer, which affects a country's attractiveness as a launch market and, indirectly, its citizens' access to new therapies. This dynamic partly explains why the FDA and EMA have expanded expedited pathways over the last two decades: it is a response to competitive pressure among regulators themselves, not only industry lobbying.
