A single accelerometer chip can cross three borders before it ever reaches final assembly: fabricated in Taiwan, packaged and tested in Malaysia, mounted onto a circuit board in Mexico, then shipped into a US automotive plant. At each border, someone has to answer three questions correctly, or the shipment stalls at customs, gets hit with an unexpected tariff, or triggers a federal investigation. This lesson walks that chip's journey to show how tariff classification, country-of-origin rules, and export-control licensing actually work on the ground.

Why trade compliance sits on the factory floor, not just in legal

Trade compliance used to be a back-office paperwork function. It is now a production-planning input. A misclassified part can add 20 to 25 percentage points of tariff cost (estimate, varies widely by product and current trade policy) overnight, forcing a re-sourcing decision mid-quarter. An unlicensed export of a controlled sensor can halt a shipment and freeze a customer relationship for months while a company negotiates a settlement with regulators.

Three regulatory questions govern every cross-border component move:

3. Can it legally leave the country? (export control)

Tariff classification: the harmonized system

Every physical good entering a country gets assigned a code under the Harmonized System (HS), an internationally standardized product nomenclature maintained by the World Customs Organization. In the US, this becomes the HTSUS (Harmonized Tariff Schedule of the United States), administered by the US International Trade Commission and enforced at the border by US Customs and Border Protection (CBP). The EU uses its own version, the Combined Nomenclature (CN), enforced by national customs authorities under rules set by the European Commission's Directorate-General for Taxation and Customs Union (DG TAXUD).

The classification code determines the tariff rate. A "circuit board assembly" and a "circuit board assembly with an integrated sensor" can sit in different HS chapters with different duty rates. Classification disputes are common and lucrative to get right: importers can request a binding ruling from CBP in advance, a free service that locks in the classification and shields the company from later penalties.

Practical example: solar panel components have been reclassified and re-litigated repeatedly in US trade disputes because whether a part counts as a "cell" versus a "module" changes which tariff and which antidumping order applies.

Country of origin: where a product is legally "from"

Country of origin is not simply "where it was shipped from." It is a legal determination based on where the last substantial transformation occurred, a change in the product's name, character, or use.

This matters enormously for tariff engineering. If a company assembles a product in Country A using only minor finishing steps on parts made in Country B, customs authorities can still rule the true origin is Country B, defeating an attempt to avoid tariffs by rerouting final assembly.

The US-Mexico-Canada Agreement (USMCA), which replaced NAFTA in 2020, adds another layer for North American manufacturing: preferential tariff treatment requires meeting specific rules of origin, including regional value content thresholds and, for automotive parts, minimum percentages of North American steel, aluminum, and labor paid at defined wage floors. A part that technically originates in Mexico but fails USMCA's origin test still pays full most-favored-nation tariff rates, not the preferential zero rate.

Back to the accelerometer: if the Malaysia packaging step is judged a "substantial transformation," Malaysia becomes the country of origin for tariff purposes, not Taiwan, even though the semiconductor itself was fabricated there. Export controls: when the part itself is the risk

Separate from tariffs entirely, some components cannot leave the country without a license, regardless of duty paid. This is export control, and it exists because certain technologies have both civilian and military uses: dual-use items.

In the US, dual-use exports are governed by the Export Administration Regulations (EAR), administered by the Bureau of Industry and Security (BIS) at the Department of Commerce. Items are checked against the Commerce Control List (CCL); if listed, an Export Control Classification Number (ECCN) determines whether a license is needed, based on destination country, end user, and end use.

Military-specific items fall under a stricter regime: the International Traffic in Arms Regulations (ITAR), enforced by the State Department's Directorate of Defense Trade Controls (DDTC). ITAR-controlled items generally cannot be exported to foreign nationals at all without a license, even inside a US facility, a rule that affects hiring and plant access, not just shipping.

The EU runs a parallel regime under the EU Dual-Use Regulation (Regulation (EU) 2021/821), with export licensing administered by individual member states but coordinated at the EU level.

Why the accelerometer matters here: MEMS accelerometers and gyroscopes with certain precision thresholds are dual-use because they're used in missile guidance as well as smartphones and cars. This is also why the Entity List matters: a BIS-maintained roster of foreign companies barred (or restricted) from receiving US-origin items or technology. A subcontractor's subcontractor landing on that list mid-project can force an unplanned redesign of the supply chain.

Free Trade Zones and duty deferral

Manufacturers use Foreign Trade Zones (FTZs) in the US, or bonded warehouses in the EU, to delay or reduce duty exposure. Goods entering an FTZ are legally outside US customs territory until they leave the zone for domestic consumption. This lets a manufacturer import components duty-free, assemble a finished product, and pay duty only on the finished product's (often lower) tariff rate, or avoid duty entirely if the product is re-exported. Automakers use FTZs heavily for exactly this reason.
