# Environmental law: EPA rules that decide what you can dump, burn, or emit
A mid-size chemical coating plant in Ohio wants to switch to a faster-curing solvent that cuts production time by 20%. Chemical coating processes release volatile organic compounds (VOCs), carbon-based chemicals that evaporate easily and react in sunlight to form ground-level ozone (smog). They may also emit hazardous air pollutants (HAPs), a list of roughly 190 chemicals (including toluene and xylene, common in coatings) that EPA regulates separately because of cancer and toxicity risks, even in small quantities.

1. Permitting tier depends on volume. A plant emitting above certain thresholds (major source thresholds vary by pollutant and by whether the area is in "attainment" with air quality standards) needs a Title V permit, a comprehensive federal operating permit that documents every emission point, control device, and monitoring requirement. Coating plants rinse equipment, treat surfaces, and sometimes wash down floors. That wastewater carries metals, solvents, and suspended solids. Two CWA mechanisms control this:
1. NPDES permits for direct discharge. If a plant discharges directly to a river or stream, it needs a National Pollutant Discharge Elimination System (NPDES) permit, which sets numeric limits (measured in milligrams per liter, or concentration limits) for pollutants like heavy metals, pH, and total suspended solids.
2. Pretreatment standards for indirect discharge. Most manufacturing plants do not discharge directly, they send wastewater to a municipal sewage treatment plant instead. Why this constrains process choice: a coating chemistry that uses hexavalent chromium (a known carcinogen and a classic industrial wastewater metal) will face far tighter discharge limits and monitoring costs than a chromium-free alternative. Many manufacturers have reformulated products specifically to avoid the compliance burden of metal-bearing wastewater, not because the metal-free version performs better, but because it is cheaper to permit and monitor.
